Fair Housing and Equal Opportunity


It is essential that REALTORS® understand the reasons and obligations under Fair Housing Laws.

Real estate brokers and their agents are subject to a web of federal, state, and local fair housing laws that are intended to uncover and eradicate discriminatory conduct in the sale or rental of dwellings. The methods of enforcing these laws are varied and the penalties that con be extracted for a violation are some of the most severe the law will allow. The practical effect of a finding of liability for most real estate firms is an unbearable financial loss, coupled with loss of reputation, humiliation, and public embarrassment. Noncompliance with fair housing laws is a risk that responsible real estate brokers simply cannot assume as a cost of doing business. Furthermore, fair housing cases are almost always excluded from errors and omissions insurance policies. Thus, the only risk reduction technique available in the area of fair housing is the adoption of a strict company compliance policy, and the action to ensure that salespeople adhere to it.

Fair Housing Laws are based upon the 1866 Act relating the ownership and rental of real estate.

FEDERAL LAW

The 1866 Act provides that: All citizens of the United State shall have the same right, in every State and Territory, as is enjoyed by white citizens thereof to inherit, purchase, sell, hold, and convey real and personal property.

In 1968 in Jones vs. Mayer, the US Supreme Court held that the 1866 Act prohibits ALL forms of racial discrimination in real estate, whether committed by government or private parties. Persons suing under the 1866 Act are entitled to recover actual and punitive damages, and their attorneys fees and costs.

Title VIII clearly defines actions that are discriminatory: Title VIII is a comprehensive fair housing law that addresses not only racial discrimination, but also discrimination on the basis of religion, color, national origin, sex, handicap and family status. Title VIII prohibits five different types of discrimination:

refusals to sell or rent, or otherwise making unavailable a dwelling because of a prohibited classification; discrimination in the terms;

conditions or privileges of sale or rental, or in the provision of services in connection therewith;

use of advertising that expresses a preference for persons of a particular race, color, religion, sex, national origin, handicap or familial status;

representations of a dwelling not available for sale or rent, when in fact the dwelling is available;

attempts to induce a person to sell or rent a dwelling by referring to the prospective entry of persons of a particular race, color, sex, religion, national origin, handicap or familial status.

In addition to prohibiting specific practices involving the sale or rental of dwellings, Title VIII also prohibits discrimination in financing of housing, or red lining, as well as discrimination in access to Board of REALTORS® multiple listing services, or other services, organizations, or facilities that relate to the business of selling or renting dwellings.

Minnesota Law outlines additional protected classes

MINNESOTA LAW includes the protection from discrimination of individuals because of age, source of income, martial status and sexual preference. Individuals believing they have been discriminated against may seek relief through the Minnesota Human Rights Commission, HUD and the Attorney Generals Office.
